Understanding the issues related to clearing copyright can be challenging, in part, because each situation requires a fresh examination of the issue. These guidelines are not intended to act as a substitute for legal advice which should be obtained when necessary.
Canadian copyright law
Copyright protection is automatic in Canada. A work need not be registered with the Canadian Copyright Office nor does it have to be marked with a © to indicate that it is copyright protected.
A copy of the Canadian Copyright Act is available here. Please note that the act is under review; therefore, it is recommended that you check for revision information.
It is important to understand the basics of Canadian copyright law and how it relates to film and underlying works such as music, literature, and promotional material for film. As well, it is important to know that Canada is a member of two international copyright treaties. Thus, when work is used in Canada, Canadian copyright law applies; when it is used in another country such as Germany, German copyright law applies.
